Terms of Service

1. Scope of Application

These GTC apply to the supply of digital content and digital services, unless expressly agreed otherwise. Digital content is data created and provided in digital form. A consumer is any natural person concluding a legal transaction for a purpose attributed neither to a mainly commercial nor a self-employed occupational activity.

2. Account

Using the editor requires logging in with a Discord account and being a member of the BandoClothing Discord server. You are responsible for your Discord account. We may suspend accounts that break these GTC or the server rules.

3. Conclusion of the Contract

The products on the website do not constitute binding offers by the Seller. The Client submits a binding offer by clicking the payment button in the checkout. The contract is concluded when the payment is confirmed and the coins or the plan are credited to the account. German and English are available for the conclusion of the contract.

4. Coins, Exports and Plans

• Coins are a prepaid credit for exports in the editor. Designing, saving and previewing are free; coins are only deducted once an export has been built successfully.
• Coins have no cash value, cannot be paid out or transferred to another account and do not expire.
• Monthly plans renew automatically every month and are charged to the payment method used at checkout. The included coins are credited at the start of each billing period.
• You can cancel a plan at any time in your dashboard. The cancellation takes effect at the end of the current billing period; coins already credited stay on your account.
• If a renewal payment fails, the plan is paused until the payment succeeds.

5. Right to Cancel

Consumers are entitled to the right to cancel. For digital content not supplied on a tangible medium, the right of withdrawal expires once performance has begun, provided the consumer has expressly consented to immediate execution and acknowledged the loss of the right of withdrawal. 6. Prices and Payment Conditions

Unless otherwise stated, prices are total prices including statutory sales tax (VAT). Payment is made by credit or debit card via Stripe. Discount codes apply only as shown in the checkout.

7. Delivery

Coins and plans are credited to your account immediately after payment. Exports are delivered as a download in your browser the moment they are built. There is no physical delivery.

8. Rights of Use

The Seller grants the Client the non-exclusive, non-transferable right, unlimited in time, to use exported clothing on FiveM servers the Client operates or plays on. Reselling, sharing, redistributing or leaking exported files or base models of the Seller is prohibited, regardless of how they were obtained.

When you upload images into the editor, you confirm that you hold the necessary rights to them. You grant the Seller a free, non-exclusive right to store these images, show them to the team and add them to the public pattern and logo library. You can ask us to remove an upload at any time.

9. Warranty

The statutory provisions on liability for defects apply. If an export does not work, contact support on Discord and we will fix it or rebuild it.

10. Liability

The Seller is liable without limitation in the event of intent or gross negligence, injury to life, body or health, under a guarantee promise, or under mandatory product liability law. For negligent breach of a material contractual obligation, liability is limited to foreseeable, contract-typical damage. Otherwise liability is excluded.

11. Applicable Law

The law of the Federal Republic of Germany applies under exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that mandatory provisions of the country of habitual residence are not withdrawn.

12. Alternative Dispute Resolution

The Seller is neither obliged nor prepared to attend a dispute settlement procedure before an alternative dispute resolution entity.
